Collection Commission on Accounts Actively in Business

Accounts $501.00 and over:

25% on the first $2,000.00

 

20% on the excess of $2,000.00

Minimum Commissions:

50% on accounts $500.00 and under

 
REGULAR COLLECTION SERVICE: The above rates apply.

CLAIMS IN LITIGATION AND FORWARDED THROUGH NACM AFFILIATES, AGENTS OR ATTORNEYS:

Accounts are generally forwarded to an affiliate or attorney with a ten to fifteen percent increase in commission rates. If legal proceedings are necessary the creditor will be required to advance the court costs and suit fees requested by the attorney. The attorney fees as allowed by the court are retained by the attorney. Commercial collection rates are not always obtainable on forwarded accounts in certain localities where higher rates may apply. We reserve the right to request a higher rate in these cases. Legal action will not be taken without authorization.

SPECIAL ACCOUNTS:

Certain accounts require special handling and will be handled at fifty percent. These are accounts that:

  • require skip tracing,
  • were previously handled by another collection agency or attorney,
  • are out of business,
  • are one year or older.

If merchandise or product is returned or received as payment, settlement, or partial credit, one-half of the regular rate/commission will apply. However, if the account is forwarded or in litigation, one-half of applicable or prevailing rate will apply. When it is discovered that a payment was made prior to assignment, a discovery fee of ten percent will be due. However, if the accounts forwarded, one-half of prevailing rate will apply.

A cross-complaint is a independent action which must be defended separately. It will be necessary for the creditor to retain an attorney to defend the cross-complaint.

SPECIAL RULES AND REGULATIONS:

When accepting accounts for collection, the Association acts only as your agent and does not assume responsibility for the acts, omissions , neglect or default of the correspondent, attorney or sub-agent to whom the account has been forwarded for collection or legal action. The association is authorized to endorse and deposit checks and to deduct fees, charges, commissions. If the Association advanced any funds, costs or fees they will be deducted from first recoveries. Should it be necessary to forward the claim to an attorney, we are authorized to do so. Legal action will not be instituted without your approval.

Creditor represents and warrants that its claims arise out of commercial accounts and not consumer accounts.

COMMISSIONS:

Commissions will be charged in accordance with the type of account as classified. In the event of direct payment to you, commissions will be based on the date that the Association received notification. Commissions are due regardless of whether payment is made to you or collected by your representative. Payment is due and payable upon presentation of invoice.

All Commissions are deducted from payments received by the Association. You will be invoiced for direct payments. Any delinquent commissions, fees, costs or suit fees will be deducted from current amounts due creditor. All interest collected in addition to the principal will be retained by the Association to defray its costs and expenses. Accounts placed for collection are not subject to withdrawal without payment of the commission.
